Exclamation Not just Convicted/Sentenced,but RAILROADED

Hello All,

I needed to begin writing my story before I explode. But for those of you who wish not to read the entire thread, my husband was convicted and sentenced to 22 1/2 to 45 years in prison after being out on bail for 5 years.

I have been so confused, hurt, and saying to myself how could this have happened to my family after all that we have been through. I feel so alone and then not hearing from him doesn't help the situation. I am hoping that someone out here on this site can help me to understand what I have to look forward to.

We have started the appeal process but many have said that the DOC of Pennsylvania is horrible and do not keep the inmates/convicts safe or even really care about them or us as familiy members of these inmates/convicts.

My husband had not just a shoty lawyer representing him (he really had only one eye that he could see out of and was deaf in one ear). The Judge stated everyday of the trial that she didn't understand how he could be out on bail and that she should revoke his bail. Could she have done that, and is it inappropriate for her to say? Was it right for her to bring up a prior arrest that was thrown out "with prejudice" (meaning that he could not have been arrested for it again later). Shouldn't the arrest of the arresting detective been brought up? The line up was even tainted. This whole case is a shame and I don't even know where to start with helping to bring my husband back to his family.

I am so angry with the judicial system that it has discouraged me from believing in those who dictate and are to uphold the laws of our country.

Can any one help with the posed questions? I hope so and I thank you in advance.

GET AN ATTORNEY AND APPEAL, APPEAL, APPEAL.... they'll probably make him serve at least 5 b4 they let him go, they gotta get some time out of people.... but APPEAL APPEAL APPEAL... LAWYER'S COST, CALL EVERYONE, WRITE NEWSPAPERS, DO ALL THAT, SOONER OR LATER, SOMEONE WILL HELP...

My Husband was also convicted and is in prison in california, There's not much that you can do once their locked up,the system has control over thier lives.Your doing the right thing by appealing it but it will take some time.The justice system in california isn't much better.They don't care about the inmates out here or thier families,usually there rude.It took 5 months before i got to see my husband.there were no phone calls or visits until then.so I know what your going through,I'll say a prayer for you and your family.

My husband is at the Bartlett State Jail privately owned. We think he should have stayed at Huntsville Unit. The day before he was to see the committee he was transferred to the Bartlett unit. He was sentenced for 2 yrs. He's release date is Nov. 11,2010. He keeps after me to write letters to the parole board so that maybe they will give him parole. For me to go see him its about a four hour drive one way. I am trying to get him moved closer. If anyone has any advice on ether topic please let me know. Thanks for reading

Example Parole Letters

--------------------------------------------------------------------------------

THIS IS HOW I WOULD DO IT!
Others please provide examples of how you would do it.

Letters should be in the inmate’s hands one month before the hearing. The letters should be typed if at all possible. Use this as an example. Don’t copy it word for word. Write it in your own words. After the hearing send a Thank You note to each sender telling him/her the outcome. If it is no parole, ask that you can make a request for a new letter when the time comes.

Each letter should

be dated;
should have the sender’s address/or phone number.
have the inmate's full name and DOC number;

Dear Sir or Madam:

introduce the sender
- who the sender is, example: how long at the same job or residence, type of work (show sender is a stable citizen)
- how he/she knows the inmate
- how long he/she has known the inmate

recommend the inmate be paroled wit an explanation:
- I recommend John Doe be paroled. I believe he has made mistakes in the past, however, I believe he will do his best to follow the law if released. He has told me of his work in the facility kitchen and the AA program he has participated in. I feel these experiences will help him to cope upon his release.

Describe the support the sender can provide:
- I can only provide moral support an encouragement.
- I can provide rides to work and AA meetings.
- I can provide a stable home for John Doe while he is on parole.

Thank Parole Board
- Thank you for reading my letter and considering John Doe for parole.
- Your consideration in reading this letter is appreciated.
- Please consider my comments in your decisions to parole John Doe.

- Please feel free to contact me if I can be of any further assistance in this matter.

Yes Maam the justice system in Pennsylvania is ridiculous. That my friend is why the system is crumbling financially. Pray , appeal and have patience because this system is so broken they are going to have to start early releases. The state can't afford private contract prisons and cant afford it's own system. So whether it will be swine flu or a California situation it is unknown but stay prayed up for our loved one's and staff safety. As far as the lawyer if he was that bad start looking at his dids and did nots for the basis of your appeal. After 16,000 dollars for our lawyer the judge had to correct him on misinformation to me and my son a couple diffrent times. Hence we have dove into the murky waters of retaining a lawyer again. Thousands again! So to my second job and scratch offs I go. lol

In responce to Rhemar.. My husband was convicted and sentanced to 25 years.. I too am ANGRY, MAD, my blood is boiling within me.. His original charge was in 2003!!! and it wasnt until 2009 that they actually sentanced him.. This system..strangly called "justice" is fu**ed up!! I am so upset with tha system..the presidents worried bout freakin healthcare reform all while this injustice is takin place in the "JUSTICE" system.. you no theres rapist's and murders out there who get 10 years!!! 10 years!! and then they have the odasity to give 25 to sum1 who didnt hurt a soul!!!!!! i dont really have ne advise for you.. but i do understand how u feel... a quarter of a CENTURY... for some bulls**t a$$ charge..

Girl now lets not even mention the state of Kansas and how they are about things because I would totally outrage every one who hears the stories ,.. But here goes any way & that is that here in Shawnee county Ks over the past 2 years now that I am aware of.... Our courts have been granting probation for some serious child predators ..All the while they hand down huge sentences for drug offenders ...Then we also have crazy things like on one night when a twenty year old male walking down the street got harrassed by some people drunk at a party , till there became an altercation between them where the ones at the party left their yard to get into physical fight with the other boy after which when the twenty year old male took off after the fight , one of the ones who had problems with him decided to fire shots at him striking him twice in the back of the head,killing him instantly,, But the man was only convited of manslaughter and recieved a total of three years...Then we have the case where a man was running from the police in a high speed chase and wrecked the vehical killing his own cousin in the car with him ,, they charged him with 1st degree murder convicted of 2ed degree murder...Then theres the guy charged & convicted of 91 counts of child pornoghraphy only got and recieved 4 years eligiable for parole in two years ... Well I could go on & on & on but I am sure that I don't need too....
