Post I have a question?

My boyfriend's niece lost her kids to the system a year and a half ago. now she's back doing time. my question can they legaly adopt the kids? i mean she had a list of things to do and a time line and the part she got in trouble again-the court date was set before she got in trouble-so you know all the would's and should's is coming through my mind.

Yes they can. The fedz mandate that after 12 months in foster care, a permanant placement be found for a child. AT the 12 month point there is a hearing held called a Permanancy Planning Hearing. At that hearing, the judge will decide if it is possible for the child to be returned home in the next six months. If not, the goal will be changed from reunification with parents to adoption, guardianship, or custody with a relative or court approved caretaker. Usually the courts will move toward adoption if the child is under age 12 because it considered a more stable placement.
