Angry How can this be POSSIBLE!?!??!?!?!? My brother's WEIRD case/situation!

Hello All, I need someone to help me get some answers here.

My younger brother got locked up almost exactly 2 years ago for drug possesion. Can you believe that he HAS NOT YET BEEN SENTENCED! Ever since he was taken in, he was taken to jail and not yet seen a judge. Is that even legal these days, in this great country of ours?

The worst part is that my bro has basicly no family there. We all live in Puerto Rico. Our mom died and there really isn't much we can do from this island to find out what's going on.

The lawyer always anounces that the judge cancelled the view and postponed it for months later, then when that day comes, supposedly the judge postpones it again.

My bro is really frustrated! He feels alone and what's worst, nobody can give him answers of his situation!

Can someone please offer me some advice? What can I do? Who can I call? Can I write to the judge? Thanks for reading everyone!

Find him a good Lawyer or get legal advise from Legal Aid!!

I am not a lawyer, but I think, according to the Constitution, everyone has the right to a speedy trial.

Who know, his situation may be a blessing in disguise, and his case may be dismissed because it took them too long to prosecute him.

Im not sure of what can be done about that. The only hope i can tell you is that when he finally does reach the court, he should get alot of that time served

Tony,

There is definitely no harm in writing the judge of the county or precinct where he is serving. You may also want to contact the warden of the facility your brother is at and ask what is going on. If the attorney representing your brother is a public defender, I would advise that your brother request a new attorney. Seems this one doesn't care how long your brother sits in there and is definitely not working to get him out.

You are right every one is entitled to a speedy trial..So there for his rights have been violated..He needs to get a different lawyer for real..There is not that much post poning in the world 2years oh noooooooooooo....Get him another lawyer you know your first consultation with a lawyer is free so i advise you to check with some...Good luck

Do write whoever you can. my boyfriend was in jail for a year and 10 days, then out for 9 months before he was sentenced. He is now (FINALLY) doing his time and getting it over with.

2 years is not uncommon in Texas. From the time my husband was arrested to when he went to trial it was 20 months. We saw inmates go to trial and then straight home because they had already served enough time before they were convicted and sentenced.

He has to ask for a speedy trial. But yeah they do that. They post pone thing. The system is all messed up.
